I may be wrong but it looks to me like holly (Ilex aquifolium) - the mature plants don't have spiky leaves.

Thank you colincb. I believe it may be a Skimmia. However, your pics are nor clear enough to be positive. I am not sure that it is a very happy shrub!

Thank you Silver Surfer, I believe you've cracked it. I crushed one of the leaves and it's quite aromatic. we've taken some cuttings from the old girl so hopefully we will have some progeny. Many thanks for your time.

You could try growing them from seed. Advice found on link below......
Or even start with a new plant bought at your local garden centre!
Many Skimmia are either female OR male. You need both to get berries!
However, if this is the only one in the area it may be Skimmia japonia subsp reevesiana, which is self fertile.
